The short version
- GymFork is for people 16 and older. If you’re under 18, a parent or guardian has to agree to these terms and to any subscription.
- A free trial turns into a paid subscription unless you cancel at least 24 hours before it ends. Cancel in your iPhone’s Settings app: tap your name, then Subscriptions.
- Deleting the app does not cancel your subscription.
- Apple handles all payments and refunds.
- GymFork is not medical advice. Its calorie numbers are estimates and can be wrong.
- Play fair: don’t hack, copy or misuse the app.
1. About these terms
These Terms of Use are an agreement between you and Flint Social Marketing, operating as Flint AI Systems, a sole proprietorship in Nova Scotia, Canada (“we”, “us” or “our”), the maker of GymFork. They cover the GymFork app and our website, gymfork.com. By using either one, you agree to these terms. If you don’t agree, please don’t use them.
Three documents work together:
- These terms.
- Our Privacy Policy at https://gymfork.com/privacy, which explains how we handle your data.
- Apple’s Licensed Application End User License Agreement, called the “Standard EULA”. It is Apple’s standard set of rules for using apps from the App Store: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
These terms add to Apple’s Standard EULA. If the two disagree about your right to use the app, the Standard EULA wins.
2. Who can use GymFork
You must be at least 16 years old. If you’re under 18, or under the age of majority where you live (the age you legally become an adult, which is 19 in Nova Scotia), a parent or guardian has to read these terms and agree to them, and to any subscription, for you. If you’re under 18, GymFork sets your food targets to fuel training and growing: it never sets a weight-loss goal or a calorie deficit, and it won’t let a target go below a safe minimum.
3. Your account
- You make your account at the end of the sign-up quiz, with your email address and a 6-digit code we email you, or with Sign in with Apple. There’s no password. Your logs are backed up with your account, so they come back if you sign in on a new phone.
- Give true info in the sign-up quiz, including your age. If Apple tells the app your age range, the app uses it too.
- Keep your email account (or your Apple Account, if you use Sign in with Apple) safe, because signing in to GymFork goes through it. You’re responsible for what happens in your account.
- We’ll email you what the app needs, like your sign-in code. We only send tips and offers if you ticked the box for them, and you can unsubscribe from those any time.
- One account per person. Don’t share it, rent it or sell it.
- If you think someone else got into your account, email support@gymfork.com right away.
4. Subscriptions and free trials
Some features need a paid subscription. Before you buy, the app shows the plan, how long it lasts, the full price and what you get.
- Payment. Apple charges your Apple Account when you confirm the purchase. If your plan starts with a free trial, Apple charges you when the trial ends.
- Free trials turn into paid plans. Unless you cancel at least 24 hours before your trial ends, it turns into a paid subscription and you’ll be charged. If you buy a subscription during a trial, any unused trial time ends.
- Auto-renewal. Your subscription renews by itself at the end of each period (for example, each month or each year) unless you cancel at least 24 hours before the period ends. Apple charges the renewal within the 24 hours before the period ends.
- How to cancel. On your iPhone, open Settings, tap your name, tap Subscriptions, tap GymFork, then tap Cancel Subscription. You can also cancel at apps.apple.com/account/subscriptions. After you cancel, you keep the paid features until the end of the period you already paid for.
- Deleting the app or your account does not cancel your subscription. Apple keeps billing you until you cancel as shown above.
- Price changes. If the price goes up, Apple will tell you first. Where the law requires it, you’ll need to agree to the new price to keep your subscription.
- Refunds. Apple handles all payments, so Apple handles refunds too. Ask for one at reportaproblem.apple.com. We can’t give refunds for App Store purchases ourselves. This doesn’t take away any refund rights your local law gives you.
- If you’re under 18. If Apple’s Ask to Buy is on for your account, a parent or guardian approves the purchase before it goes through. Nothing in these terms takes away any right the law gives you, or your parent, to cancel a purchase you made as a minor and get your money back.
- Restoring purchases. If you get a new phone or reinstall the app, go to Profile > Subscription > Restore Purchases in the app, while your iPhone is signed in to the same Apple Account you used to subscribe.
5. Not medical advice
GymFork helps you track food and workouts. It is not a doctor, a dietitian or a personal trainer, and nothing in it is medical advice.
- Talk to a doctor before you make big changes to how you eat or train.
- Don’t use GymFork to change your diet or training without a doctor’s OK if you:
- have or have had an eating disorder,
- are pregnant or breastfeeding, or
- have a medical condition (like diabetes, heart disease or kidney disease) or take medicine that diet or exercise could affect.
- Stop and get help if you feel chest pain, dizziness, trouble breathing or sharp pain while training. In an emergency, call 911.
- You decide how you eat and train, and you’re responsible for doing it safely.
- If you’re under 18, talk to a parent or a doctor before you change how you eat. GymFork won’t set a weight-loss target for you.
6. The numbers are estimates
Every number in GymFork is an estimate and can be wrong.
- Your calorie and macro targets come from standard formulas: for adults, the Mifflin-St Jeor formula, and for 16- and 17-year-olds, the teen energy equations Health Canada publishes. They’re shown as ranges, and they’re a starting point, not a prescription.
- The weekly check-in’s suggested calorie targets are estimates too. They’re worked out on your phone from what you logged and your weight trend, and they never change your targets unless you tap to accept.
- Food database entries and barcode data can have mistakes.
- Data from Apple Health, a watch or another app can be off too.
We don’t promise any level of accuracy. Check your entries and use common sense.
7. Your content
Your food logs, saved meals, workouts, measurements, progress photos and notes are yours. You give us permission to store them (on your phone and on our server, except progress photos, which stay on your phone), process them and show them to you, only so we can run GymFork the way our Privacy Policy explains. This permission ends when you delete the content or your account, except for copies in our backups, which are gone within 90 days.
When you share a PR card, you choose where it goes, and we don’t see it.
If you send us ideas or feedback, we can use them to improve GymFork without paying you or owing you anything.
8. Using GymFork fairly
Don’t:
- break the law, or use the app to hurt anyone;
- hack, probe, overload or try to break the app, our servers or anyone else’s account;
- copy, change or reverse engineer the app (take it apart to see how it works), unless the law allows it;
- use bots, scrapers or other automated tools on the app or our servers (if you want our food data, see section 9);
- get around the paywall, the free trial limits or any other limits;
- pretend to be someone else.
9. Our app
We own GymFork, including its name, logo, design and code. Apple’s Standard EULA gives you a personal right to use the app that you can’t pass on to anyone else. These terms don’t give you any other rights to it.
Our food data comes from three places. Generic foods come from USDA FoodData Central, which is free public data from the U.S. government, and from Health Canada’s Canadian Nutrient File, which is shared under the Open Government Licence - Canada. Branded foods and barcodes come from Open Food Facts, which shares its data under the Open Database License (a license that lets anyone use the data as long as they credit it and share any database made from it under the same license). Our own database made from Open Food Facts is available under that license if you ask for it. See the food data credits on our help page at https://gymfork.com/support.
We keep improving GymFork, so features may change. If we plan to remove a major paid feature, we’ll try to tell you first.
10. Ending your use
You can stop using GymFork any time. To delete your account, go to Profile > Account > Delete account in the app. Your account and data are deleted right away. We keep only anonymous purchase records, with nothing that identifies you, for accounting and tax. Remember to cancel your subscription separately (see section 4).
We may suspend or close your account if you seriously or repeatedly break these terms, or if the law requires it. We’ll tell you why, unless the law or someone’s safety stops us.
If we learn that someone under 16 is using GymFork, we’ll delete their account.
If we ever shut GymFork down, we’ll tell you at least 30 days before, so you can download your data.
11. Limits on our responsibility
We work hard on GymFork, but we provide it “as is”. That means we don’t promise it will always work, be free of mistakes or get you to your goals.
As far as the law allows:
- We aren’t responsible for indirect losses, like lost data, lost money or missed goals.
- We aren’t responsible for injuries or health problems that come from how you choose to eat or train.
- If we are responsible to you for anything, the most we’ll owe you is what you paid for GymFork in the 12 months before the problem, or CA$50, whichever is more.
Nothing in these terms takes away rights that the law says can’t be taken away, like your rights under consumer protection law, or our responsibility for fraud or for harm we cause through serious carelessness.
12. About Apple
These points are here because GymFork is sold on the App Store:
- This agreement is between you and us, not Apple. We, not Apple, are responsible for GymFork and what’s in it.
- Apple has no duty to support or maintain GymFork. Contact us instead.
- If GymFork fails to meet a warranty (a legal promise about how a product works) that applies to it, you can tell Apple, and Apple may refund the price you paid for the app. As far as the law allows, Apple has no other warranty duty for the app.
- We, not Apple, handle any claims about GymFork. That includes claims that it caused harm, claims that it breaks a law or rule, claims under consumer protection or privacy law (including about Apple Health), and claims that it breaks someone’s intellectual property rights (their rights to inventions, brands and creative work).
- Apple and its subsidiaries are “third-party beneficiaries” of these terms. That means they aren’t part of this agreement, but they can still enforce it against you.
- You confirm that you aren’t in a country under a U.S. government embargo or one the U.S. government has labelled as supporting terrorism, and that you aren’t on any U.S. government list of banned people.
- You must follow the rules of any other service you use with GymFork, like your phone or data plan.
13. Law and disputes
These terms are governed by the laws of Nova Scotia and the federal laws of Canada that apply there. If you have a problem, please email support@gymfork.com first and give us 30 days to try to fix it. If we can’t, you or we can take it to the courts of Nova Scotia. If the law where you live gives you the right to use your local courts or your local consumer laws (for example in Quebec or the EU), you keep that right.
14. Changes to these terms
We may update these terms. We’ll change the date at the top, and for big changes, we’ll tell you in the app before they take effect. If you keep using GymFork after that, you agree to the new terms. If you don’t agree, stop using the app and cancel your subscription.
15. Other things
- If a court says part of these terms can’t be enforced, the rest still applies.
- If we don’t enforce a rule right away, we can still enforce it later.
- You can’t transfer these terms or your account to someone else. We can transfer them to a new owner of GymFork, like a company we set up, and we’ll tell you if that happens.
- These terms, our Privacy Policy and Apple’s Standard EULA are the whole agreement between you and us about GymFork.
